EB-2/ NIW (National Interest Waiver) Visa

Getting a green card can be challenging.  However, there are certain paths that a person can take in order to achieve legal permanent residency status.  One of the more popular options is through an employment-based visa — particularly the EB-2 National Interest Waiver visa.

EB-2 NIW visa is available to foreign nationals with advanced degrees or exceptional abilities in the sciences, arts, business, or sports. A bachelor’s degree plus more than five years of experience can help the individual start the process.

E-2 The Treaty Investor Visa

E-2 The Treaty Investor (E-2) visa is for an applicant whose purpose for entering the U.S. is solely to develop and direct the operations of an enterprise in which the alien has invested, or is actively in the process of investing, a substantial amount of capital in a bona fide enterprise.
Treaty Investor Visa – available to citizens or nationals of 30+ countries that have trade treaties with the United States.
To determine whether the investment is “substantial” the Department of State employs a relative-proportionality test. Generally speaking, the lower the cost of the enterprise, the higher, proportionally, the investment must be to be considered substantial. For example, if the total investment is $200,000 or less, the E-2 investor should provide 100% of the investment.
E-2 visa does not provide residency (not a Green Card), one of the significant advantages is the ability to extend the E-2 visa indefinitely or for as long as the business concerned as viable.

EB-5 Visa Immigrant Investor Program

Immigrant Investor Program provides foreign nationals an opportunity to obtain U.S. permanent residency (a “green card”) for themselves and their immediate family members for investing in American businesses that create new jobs.
